Notice of Public Hearing on Proposed Rules

A public hearing will be held in the Boardroom on the second floor at South Dakota Housing Development Authority, 3060 E. Elizabeth St., Pierre, SD 57501 on July 1, 2025, at 2:00 pm Central Time, to consider the adoption of proposed Administrative Rules of South Dakota numbered

§§ 20:09:26:01 to 20:09:26:06, inclusive; 20:09:26:08 to 20:09:26:20, inclusive; and 20:09:26:22 to 20:09:26:24, inclusive.

The effect of the proposed rules is to establish a clear process for the application, approval, and disbursement of loans from the South Dakota Housing Infrastructure Financing Fund, as authorized by SDCL Chapter 11-15. The proposed rules are intended to support the new law that allows loans for the expansion of school districts located adjacent to military installations. The revisions of current rules also clarify the distinction between housing infrastructure loans and loans specifically for school construction or expansion that originate from the same fund.

The reason for the adoption of these rules is a response to recent legislation authorizing loans to school districts located near military installations for school expansion purposes. In accordance with SDCL Chapter 11-15, the promulgation of these rules is necessary to ensure statutory compliance and to facilitate the effective administration of the loan program for eligible school districts.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may:

  1. Appear in-person at the hearing;

  3. May attend telephonically by calling 1-469-253-5858 and using conference ID 182 902 493#;

  5. Email them to beverly@sdhda.org.

The deadline to submit any such written comments for consideration by the South Dakota Housing Development Authority Board of Commissioners, a part-time board, is seventy-two hours before the date of the public hearing. All written and email comments must include the name, hometown/city, and the state of the person submitting the comments.

At the hearing, the South Dakota Housing Development Authority Board of Commissioners will consider all written and oral comments it receives on the proposed rules. The South Dakota Housing Development Authority Board of Commissioners may modify or amend a proposed rule to include or exclude matters that are described in this notice.
